Why Binance Does Not Have the Licence โ€” And Why It Was Never Simple

Binance is not an exchange that simply forgot to do its homework. It is the world's largest crypto exchange by volume, with over 204 million global users. The MiCA process is not an online form.

To understand the delay, you need to look at the exchange's regulatory history. In November 2023, Binance reached a $4.3 billion settlement with the US Department of Justice โ€” the largest penalty in the history of the crypto sector โ€” for AML and OFAC violations. CEO Changpeng Zhao pleaded guilty to a federal charge and stepped down.

That background inevitably weighs on European regulators' assessments. The FCA had already imposed restrictions on Binance in the UK in 2021. Germany's BaFin had issued similar warnings. The Dutch DNB fined Binance for unauthorised operations in 2023.

The figure of 15 exchanges with "trading platform" authorisation is the one that matters most for Binance. Not all 231 authorised CASPs cover full exchange trading โ€” many cover only custody, transfers, or advice. Withdrawals remain available after 1 July according to the official Binance communication. You can wait, but bear in mind that networks may become congested during the European user exodus period. The earlier you move, the less queue you face.

If you have significant funds or want to avoid the uncertainty

The prudent move is to diversify: keep part of your holdings on Binance (while waiting for developments) and transfer the rest to an exchange with a confirmed CASP. There is no need to leave Binance entirely โ€” but concentrating everything on an exchange in regulatory uncertainty is not risk management.

  4. Handle BNB separately: BNB is not on Ethereum mainnet and requires additional steps
